Legal Question in Wills and Trusts in Florida

both of my parents are deceased. they had a living will and trust. there is one small account that did not have a beneficiery on it. the company is wanting it to go to probate. probate costs and filing fees are more than what is in the account. My mother has been gone 5 yrs and my Father has been gone 2 yrs. is there any way around this to retrive the funds from this account?

You might want to see if a Disposition without Administration might work. Go to the Probate Court and ask the Clerk.

You can file a Disposition without Administration - the filing fee is approx $231.00 and you file the paper and the judge issues a letter to the company under statute to release the funds to you.
