Legal Question in Workers Comp in Florida

workman's comp law

My husband was released to return to work with specific restrictions. His boss will only let him work 25 hours per week. Will workman's comp pay the other 15 hours per week?

Re: workman's comp law

I need more information. Was your husband released to return to work while he still undergoes treatment to improve his condition? In other words has he reached MMI? If not, the carrier will have to replace some of the 15 hours he loses. Out of a 40 hour week, anything lost over 8 hours is compensated, at 80% of the loss. So he gets 80% of 7 hours pay. If he has reached MMI and has been released with permanent restrictions, he gets paid for his permanent impairment, a feww weeks pay for each percentage point of impairment (at a rate that depends on if he returned to work) and nothing for the loss of wages.
