Workmens Compensation

I am a Physical Education teacher injuried at work in Oct. I asked for an MRI and the doctor did not order one for two months. The MRI showed a Meniscus tear and he said the Meniscus would have to be removed. I feel working and physical therapy on the knee for two months may have further injured the knee to the point the meniscus could not be repaired but must be removed. I am worried about long term degeneration of the knee. Does this qualify me for a lumb sum payment for loss of the meniscus, and does my Union have any part in my protection in this case?

Any Workers' Compensation case can be settled for a lump sum if the parties agree on an amount. Otherwise, your case can continue until the day you die as long as your treatment continues to be related to the accident and you don't go more than 1 year without seeing the authorized treating physician. There are impairment benefits paid for the permanaent injury to your knee, but it only amounts to peanuts. Feel free to call or email if you would like to discuss in further detail.
