Re: Works compensation recovery

The time frame for settlement is unpredictable. Depending on your demand, and the desire for the insurance carrier to settle your case. Please keep in mind that in most instances, the insurance company is at a much greater advantage than the injured worker in settlement of the case. The insurance company will look at your impairment rating, and your ability to return to work after your accident and determine their "exposure" to future benefits. If you do not know how to value a case, or don't have experience in negotiating settlements, you should not try to settle your case without the assistance of a qualified workers compensation attorney. More often than not, a qualified workers' compensation attorney can obtain a better settlement on behalf of the injured worker than the injured worker himself, even after attorney's fees.

As for the amount of attorney's fees and costs, this depends on whether the only thing the attorney needs to do is negotiate settlement, or whether additional time is required to obtain a fair settlement. However, no settlement can be made without your approval, and knowing the amount you will clear from settlement.

I hope this answers your question. If you have any further, more specific questions, please contact a qualified workers' compensation attorney immediately.
