I am mexican-spanish and my husband is french. We have a son 9 years old, who was born in Mexico City. We live in France.

I presume you are thinking of a divorce. In that case your chances of the court attributing the residence of your nine year old child to you are very good in the absence of unusual circumstances, such as you have an alcohol or drug problem or similar reasons that would cause the court to consider that it would be in the best interests of the child to reside with its father. The father might ask for shared residence - one week with you, one week with him. If the parents live close by a judge will sometimes grant the father's request for shared custody, but the odds are always in favor of a child under 12 years old residing with its mother.

Feel free to phone me or to send an email if you want to discuss this further.
