Legal Question in Business Law in Georgia

Car Return to Dealer

My brother purchased a car, which turned out to be wrecked, when he brought it home he noticed the differences in the pannels and paint. The next day he brought the car back pointing out the differences. He tried to return it but the dealers did not accept it, after hours of arguing they ended up forcing him to get a different car (different make, model) for the same money he had paid for the initial luxury car. He got ripped of on the deal and needs to know what are his options if any? Is there a Buyers remores law in GA that gives him the ability to bring the car back, or is there a law that allows him to get his money back if the Dealer sold him a wrecked car?

Regards,

Re: Car Return to Dealer

Your brother may have had a case for the original car being in an accident, but he probably gave up those rights when he accepted a different car. There is no "buyer's remorse" law in Georgia (or any other state for that matter).

Re: Car Return to Dealer

I am afraid your brother has no recourse. A buyer has a duty to inspect before buying. Additionally, since he agreed to take the substitute care, an "accord and satisfaction" has probably taken place. He should consult with a local attorney.
