Legal Question in Business Law in Georgia

Default Judgement

Back 6 months ago my husband was asked to garnish an employees paycheck for a finance company. He was told to send back these papers within so many days. Well, the papers were sent in but not within the time frame. He then went to court and the judgement was that he was responsible for paying this money that was a responsibility of a former employee. Now there has been a default judgement on my husband's business. But since then we have incorporated the business. Can this finance company come after assests like they say they can?

Re: Default Judgement

We do not know all relevant facts, but generally a default judgment on a garnishment is the same as any other judgment and the creditor can take steps to collect. Incorporating after the fact does not generally shield the pre-incorporation assets. Since we do not know who the judgment was against (you just say "husband's business") or other facts, and this is part of a lawsuit, you need a lawyer to avoid further problems arising from not handling the case in the proper manner.
