temporary assignment terms

I was hired as a temp, worked 4 days at a great company and now the company wants to hire me.This was my first assignment through a temp agency. I was unaware of the terms surounding the temp to hire through the temp agency(ie: they take 45 % of my pay & now that they want to hire me they say that I must stay with the temp company for three months, or have the company pay 1% of every $1000 of my yearly salary.(In my case $9000)This has made it impossible for me to be hired because the company cannot afford to pay both me and the agency. My question is whiether or not I would have any legal responsability to the temp agency if I terminate my employment with them and then was hired by said company.thank you for your time.

Much depends on the language of the contract between the temp agency and the company that now wants to hire you. In most cases, there are provisions in such temp agency contracts that provide that the temp agency fees are due whenever the client companies hire permanently those temps placed by the temp agency. Check with the company that wants to hire you and have them review their agreement with the temp agency to see if there is any way for you to be hired without these fees. If not, many temp agencies will negotiate with their clients to allow them to hire temp employees.
