Discrimination, Retaliation or Both?

I began working for a Job Corps in Oct-01 as an Instructor. Jul-03 I was promoted to a Dept. Mgr. Served as Dept. Mgr until my termination in Oct-06. Received all EXCELLENT appraisals, all raises, many awards, certificates, acknowledgements, etc. Was also used to perform technical writing to obtain contracts and develop programs at other Job Corps. 2005 I witnessed a Director behaving inapprop. with a direct report; which was against policy. Upon sharing what I witnessed with another Mgr, I was later called in by the two head people, interrogated, and my job was threatened. Shortly after that, the Dir. in question was designated as my immediate Supv. I rec'd my 1st write-up under his supervision for ''poor job performance.'' I appealed the write up but was denied the appeal process. I notified HR; received no assistance. 1 month later we had a DOL review and the program area my dept. fell under (which consisted of 3 depts) received an overall failing score. I was the only Mgr fired. The assessor stated that my area passed as a standalone but the other depts brought down the overall score. I am a blk female, my Supv. was a wht male & the other Mgrs were wht females (who had failed previous assessments w/ no action taken)

Depends. The issue on both claims is goingt o be whether the reasons given for action taken against you are credible or a pretext for discrimination. A pretty big hurdle, but you can try. Take it up with local counsel who can help guide you through the agency and the EEO processes.
