Legal Question in Credit and Debt Law in Georgia

Direct Draft to pay a debt

A collection agent is telling me that the only way that they will take my payment is if I give them a direct draft. Giving them my check account info for a post dated check. They said that if they draft the money out too early that I would be able to suie the company. Trying to ensure me that they will draft the account on the day the I set up.

Should I give the comany my account infomation for a direct draft? Is there laws that protect me if they deduct too early or deduct more that the amount agree too?

Re: Direct Draft to pay a debt

NEVER EVER do what that collector suggested. Do not give them your checking account number. Any legitimate collector will take checks or money orders. Post-dated checks likely violate your own bank's rules, and in authorizing them, since you'd be violating those rules, it is very unlikely when the collector keeps looting your account that you will be able to do anything.
