Legal Question in Credit and Debt Law in Georgia

freezing checking account

I owed several credit cards and I became disabled and could not make payments.Since I have not had any activity on these cards in 4 years The statue of limitations was up about 2 months ago.I want to know if I open a checking acc. so my S.S. check can be directly deposited if these creditors can freeze my checking account.

I am wondering why you are assuming the statute of limitations has run. If you have a contract under seal in Georgia, the statute is 20 years, and most cards are based in other states with lengthy statutes that may apply.

Maybe, eventually. The statute of limitations does not prohibit a creditor from filing a lawsuit and, if not properly defended, obtaining a valid judgment. It also has nothing to do with other collection efforts the card issuers may undertake.
