Legal Question in Credit and Debt Law in Georgia

Lost package

I was charged for a package that I sent back I refused it and now it's lost and they are wanting me to pay for it and won't take no for an answer what rights do I have? The credit card company will have to investagate and the co I'm dealing with is not willing to budge on anything. I did not sign for the package they just left it I returned it to the PO and now there is no records of me sending this back.

Re: Lost package

You fail to state your original agreement with the seller as far as refunds, returns, etc. If the terms of the sale were no returns or refunds, and you actually received the delivery, you will likely be charged.

Re: Lost package

You did not post information needed to answer you. If you did not order the item, it is legally a gift to you, and you could keep it at no charge. If you did order it, unless the merchant policy is to accept returns, you had no right to return it, and, if you were going to return it, you should have insured it at your expense.

It sounds like you charged an item and challenged the charge bill. It also sounds like you will lose the challenge, either because you had no right to return the item or because you will not be able to prove they received it (and in not choosing to insure it and return it properly). All challenges have to be in writing within 60 days.

Note that if they just left the package without you signing, THEY have no proof of delivery, which would have won your challenge but for the fact that you have told everyone you got it and sent it back, proving delivery to you.
