Legal Question in Credit and Debt Law in Georgia

I was never notified on repo

I helped my daughter get acar in 2000 and in 2002 we found out she had mental problems, they the car was repo several mothes later they wanted their money and they had sold the car in SC with in a week after the got it back.

I received a letter this week that they are sueing me for 12000.00. they also sed they only got 2000.00 for the car.

I did call when I found out the car was repoed and that when they said it was sold I sent the info to my attny. Now he is not working because of a heart attach. what can I do or what rights do I have?

Re: I was never notified on repo

What do you mean you "helped" your daughter get a car? Did you sign the loan? If so, assuming the repo and sale were appropriate, you will be liable for the difference between the sale price and the loan balance.

Re: I was never notified on repo

Your post is rather unclear as to "helped". But if you co-signed a loan, you promised to pay it and would be liable for any deficiency (assuming all this happened in Georgia and the sale was done pursuant to law). You refer to South Carolina, however, in your post, and if this happened in South Carolina you need to ask there as their law may be different.
