No Records or Bill

Does a collection agency have to provide a written bill or some kind of written record, when the service was done and the results? They say I owe money for a doctor that read X-rays in the emergency room. I have tried to get some kind of records. The doctor has retired and the collection agency said he could not be reached, no records can be found in hospital or insurance co. They told me at the agency that was my problem play the bill. I can not recall going to the emergency room at this time. Do I have to pay the bill on their word and dates with out written info from the doctor?

Fair Debt Collection Practices Act

The Fair Debt Collection Practices Act requires certain people who collect other people's debt to follow certain procedures in collecting the debt. I would have to know more about the agency to answer all of your questions specifically. Generally, if it is an entity that falls within the definition of a collector within the Act, it is supposed to provide you with certain notice, and to provide you with verification of the debt if you so requested (in writing is better). If you do not even owe the debt the agency is trying to collect, you have a potential cause of action. You may also have a potential cause of action even if you do owe the debt, but the agency is collecting in an illegal manner. It is best if you contact an attorney to go over the matter in more details to see if the case is worth pursuing.
