Legal Question in Credit and Debt Law in Georgia

Small Claims Matters

I would like to file a small claims against someone who lives in the state of Georgia. I really do not want to come to Georgia for the hearing. What is the process for filing a claim against someone in another state, and would I have to be present, or could I retain the services of an attorney?

Re: Small Claims Matters

When you retain a lawyer, he/she will tell you the evidence required to prevail on your case. However, you should assume that your presence will be necessary at any trial. Small claims/magistrate court is generally based on the plaintiff showing up and stating their case.
