Legal Question in Criminal Law in Georgia

arrests

My brother was arrested several months ago for unauthoritzed use

of a credit card and drug possession. He was out on bond (that i

put up) then was arrested the day of this court date on the first

charge for driving without insurance (a crime here) and drug

possession (crack or cocaine) in his possession.

1) Since he was in jail on the latest charge when he was to appear

in court. Am i responsible for that first bond. Do i get my money

back.

2) what is the likelihood he will do time.

3) can you force someone to get drug treatment or must the judge

do that. I don't want him back in my home unless he gets help

thanks

Re: arrests

We will be more than happy to help. You need to contact the county where you posted the bond. Generally, you can't get bond money back until the case is resolved. You can't force someone into treatment, but you might want to tell him that the judge will look very favorably at his willingness to go into treatment prior to court, as a mitigating factor, and may be more lenient with him. We really need to discuss this in detail via phone or in person in order for me to give you proper advice. I will need to know what jurisdiction this occured in, and what are the specific charges. Please contact us at your earliest convenience. I look forward to hearing from you.

Sincerely,

Meg Strickler
