Legal Question in Criminal Law in Georgia

seizure of property time limitations on retriving personal items

Vehicle was seized no fault of my own. Can I have retrieve personal items in vehicle and if so is there a time limitation on retriving occurred in Oct 04 notified of seizure Nov 04. Loaned vehicle to someone for a couple of days until they could get their own fixed. Asked for vehicle to be returned at least 2 occasions prior to seizure. Person made excuses ie lost key would return upon finding key. finally set a time to go to persons house and pick up vehicle person was pulling out of driveway in vehicle when arrived. kept vehicle from aug04 until seized oct 04. anything I can do to recoup loss of seized vehicle valued at $8000.00. ask person after released from incarceration about his attorney getting vehicle released was supposedly working issue now saids atty doesn't want to approach issue of release better for person if nothing said about retriving vehicle.

Re: seizure of property time limitations on retriving personal items

It seems to me that your friend doesnt have a say-so in the matter, really. Its your car isnt it? Not your friends. You are--presumably--an innocent 3rd party who, through no fault of your own, had his car seized by the police because it was being driven by a criminal when he got busted. Your friend has a vested interest in not rocking the boathe doesnt want to piss off the same people who are going to decide how good his plea bargain is going to be. If the police have the car, go and ask for it back--play up the whole fairness bit and how this situation is being really UNFAIR to you. A lot of times all you have to do is ask. If that doesnt work get up a couple thousand dollars and hire a lawyer. Suit can be filed to recover your car.
