Legal Question in Criminal Law in Georgia

Violation of probation & using a false name

I have a friend whose is 23, He was convicted of a felony, (burglary-theft by taken - 2nd offense) he was placed on 3 yr probation, and 1 yr sentence of in-patient rehab in columbus, he was released for a weekend visit about 4 months ago from rehab, and did not return, therfore he might havwe been in violation, he is currently in paulding county jail for giving a false name, while a friend he was riding with got pulled over, (for alot more illegal stuff) what I want to know is whatis the legal procedure, I know he needs representation, and will have to be transferred over to the other jail where he was put on probation, did his sentence from the felony charge. will they offer any more intense probation, rehab etc, he does have a substance problem which got him into trouble in the 1st place.

Re: Violation of probation & using a false name

Your instincts are basically correct. Generally what happens is that the change in Paulding County will be ajudicated and then he will be sent back to Muscogee County to see the Judge that put him on Probation in the first place. Depending on the facts of the case, the Judge could put him back on probation, send him to prison, or suspend his sentence (which seems highly unlikely given what is in this message). To that end, there may be very little that can be done on his behalf at this point that would do any good. Still, to make any statement as to what might happen, I would have to know more about the case. Please contact me to discuss the case further. (404) 542-2261
