Legal Question in Discrimination Law in Georgia

Townhouse Association Discrimination

My neighbor and I received written notice from our association to remove our window air conditioners because it is''not allowed'' by our convenants. These air conditioners have been installed for eight years. Four other neighbors with window air conditioners have received no such notice. There are two reasons we believe we have been targeted: (1) we were instrumental in getting a revised covenant turned down, (2) my neighbor is Africian American, and has been hassled by this association for several years, I am Caucasion but my two roomates are Africian American. What are our legal options?

Re: Townhouse Association Discrimination

It appears as though you are violating a covenant (though you leave out the relevant fact). One legal option is to comply with your covenants, or risk the penalties you agree to in the agreements. You can also, presumably, vote for new association leaders as stated in your agreement. "Believing" you are the subject of discrimination because you are being "hassled" for a violation, or when something negative happens, without more, carries little to no weight, especailly when it may be just as easily (erhaps wrongly as well) viewed as a way to avoid liability or responsibility.
