Alimony and resignation of employment

I caught my husband in an act of adultery (2 days ago). I have contacted an attorney but my appointment time hasn't arrived yet. What happens to alimony and child support if my husband terminates his employment?

Assuming that you will be the custodial parent, he will still be required to pay child support even if he has quit his job. The amount of child support is dependant upon his earning potential and not necessarily his current earnings. So quitting his job will not necessarily prevent you from collecting child support. As to alimony, this is not set forth in the statutes as a percentage of his income and there are many factors in determining the award of alimony. So if he does quit his job to reduce or eliminate the payment of alimony this certainly will be taken into consideration in awarding an appropriate amount of alimony. The bottom line is that quitting his job will not necessarily eliminate or even reduce the child support or alimony obligation. The foregoing is general information only, not specific legal advice.
