Legal Question in Family Law in Georgia

Divorce

I am 15 years old and my parents are divorced and I ever year I go to my dad's house during school holidays like Spring Break, But this year I want to stay here during Spring Break. My mother doesn't have a problem with it, but it is my dad that may. I was wondering if my dad has the right to make me come up to see him? By our court rule he gets to see me during school holidays, but can i decide if I want to see my dad or not?

Re: Divorce

Courts enter decrees based on what is considered "in the best interest of the child." Knowing that an individual's life is enhanced by having meaninful relationships with both parents, courts typically assure that time is available for children to interact with each parent. If the court entered a decree that indicates you will spend a school holiday with your Dad, then, absent any conflicting provisions, both of your parents are supposed to carry out that order. If your parents wish to change the decree, then they will need to go back to court to seek a modification of the original decree.
