Am I Divorced?

How can I find out if my estranged husband has filed for an uncontested divorce. I do not know his location and I understand public notice is usually filed in a local paper if the other party cannot be located. There are no children or property involved and he does not know my location.

Find out what county husband resides in and call the clerk of the superior court. Ask. It is public record. I would also call the offical legal organ [newspaper] of that county and check with legal ads. You could also search online or there are professionsl services available too. A divorce by publication can only give you a divorce. A divorce by publication cannot set child support, divide property, alimony, and so forth. Those arent problems for you, however.

The first order of business is to locate your husband and determine where he has lived since you split. (He could have moved one or more times.) I would suggest Pat Coffey, a private investigator who is based in Gwinnett County (770-277-9001), but works all over the state and can find his place(s) of residence. Once you know that information, just call the clerk of Superior Court in each county in which he has lived to see if he has filed.
