Divorcing While Pregnant In Georgia

I have been sperated from my husband for16 months and am now pregnant from a new relationship. Will this hinder the proceedings any, and can the baby's father signthe birth certficate?

Legally your husband is the father, no matter what the biology says. It will take a court case to change that. You need a lawyer to deal with this, and should see one now.

My opinion concurs with that of Mr. Ashman. The legal father of your child, regardless of the biological father, is your husband. The biological father will need to initiate a legal proceeding called legitimation if you want the new father to be the legal father and have custody and access rights to the child. I'm not sure what effect, if any, it would have for him signing the birth certificate other than acknowledging paternity and a presumed duty to support.
