Ex-wife forged my name to register a car in another state

Two years ago, my wife drove to Georgia to visit her mother & never came back. The car was registered in WA state, under my name. The loan for the car is in my name. My wife decided to stay in Georgia and forged my name to get Georgia plates and register the car in her name. Up until 6/09, she has been making the loan payments on the car. We divorced in 10/08. As of 6/5/09, she is 12 days late on the latest car payment. The loan company contacted me, since the loan for the car is in my name. The balance of the loan is $3,500.00. There was a verbal agreement between my ex-wife and I, that if she paid off the loan for the car, I would sign the title over to her. Now all that has changed. If I don't start making payments on the car, my credit will be ruined. Is there a way that I can get the car from back her? If not, can I press charges against her for forging my name to get the car licensed in Georgia. I doubt the loan company would let me off the hook for the balance of the loan. What are my rights. There's no point talking to my ex. She is mentally unstable.

I'd suggest you talk to your divorce lawyer. Your rights have a lot to do with the one thing you didn't tell us (what those papers do and do not say) and likely very little to do with what you and your ex orally did.

Regardless, as I am sure your divorce lawyer warned you, you remain liable on the loan.

Mr. Ashman's advice would apply in WA also. If your divorce was done in WA, I would recommend that you read your Decree of Dissolution of Marriage and specifically paragraphs 3.2 through 3.6 for details on how property and debt are distributed.
