If I find out through my wifes emails that she has been cheating can I use it in divorce?

First of all, since Georgia has a no fault divorce ground, it is unnecessary to prove fault to get a divorce. However, adultery may be a defense to alimony claims and be of help in some cases.

Yoyur big problem will be how did you get the mail. If you accessed her mail wiuthout her permission, you may have committed a serious felony and face prison and large fines.

So step one is to see a lawyer and determine (1) if you are likely to go to prison when you disclose the email, and (2) if you did get it legally, can and should you use it.
