Legal Question in Family Law in Georgia

What are the laws when a husband and wife are going to get a divorce in GA but they have a 2yr old son. The wife will have to leave the state to go to IN and wants to take their son. She has been the sole caretaker but a stay at home mom since pregnancy. He works and pays the bills in GA. She has family in IN and that is the only place she has to go to.

What are the laws about what? You refer to the people as he and she, so I gather you aren't either party in the case. But they both need lawyers.

If the spouses are currently going through a divorce, there are standing orders that prohibit moving, selling assets, etc. without court approval. Therefore, file a petition with the court to obtain permission to move. Include in your petition the reason for the move.

Of course, it is better to retain an attorney for a divorce. If you cannot afford an attorney, you might be able to qualify for a pro bono attorney.
