How long it take emergency hearing has filed before going to court.

My lawyer filed emergency hearing last week and he say that they havevto locate my ex before we going to court. My ex went to my kids school on May 23, 2012 and check out my boys without my knowledge after he told the court last December 2011 that he live and work in Nigeria. At this time I don't know what to do because my lawyer doesn't seem to be doing anything. I'm very very afeard that my ex can run to his country before my lawyer get a court date.

There's no way anyone here can really tell you more than your lawyer.

Most courts face numerous emergencies, many of which get priority on a calendar before civil matters. for example, everyone who is arrested HAS to get a hearing within 48 hours. So while I understand why you consider your case an emergency, in the best of times, expecting a hearing within a few days (especially when two of those days were on a weekend) is completely unrealistic. In other words, your expectation of what miracles your lawyer can do are very unrealistic.

Discuss your concerns with your lawyer, not here, and ask him, on a weekday, what progress has happened in calendaring a case. And he's correct as to the need for service. So give him all the information you have on location, and consider spending a good bit extra on a private investigator and special process server to find and serve your ex.
