Legal Question in Family Law in Georgia

my son's ex is suing him for back child support claiming he never paid. he paid her in cash and she would come to his job to get the money with several witnesses seeing this. can we prove he paid this money with the witenesses including myself?

You can try, but please tell your son he is not using his brain. And he probably will lose without receipts.

NEVER pay chiuld support without proof. That means keep cancelled checks or money oredr receipts. Do not pay cash without a written receipt.

I cannot tell you how many times I have heard this scenario. The court could take into consideration the input of witnesses, but it is doubtful. The witness may have seen cash change hands. However, he/she may not know the amount. The ex could say it was for clothes, a gift, medical, etc. and not support. Tell your son to get a receipt book if he wants to pay in cash. A cancelled check or a money order (carbon money orders are best so he can show who it is made payable to), otherwise, take make a photo copy of the money order.
