Legal Question in Family Law in Georgia

Ex- Spouses residence

In the event of my ex-husband's death, I am entitled to the house I currently live in. However, what I want to know is, what happens to the house and property that he currently lives in? Would that go to the kids or do I inherit it or does he have to stipulate what he wants done with that property in his will?

Re: Ex- Spouses residence

You have no right whatsoever to an ex-spouse's property at all unless (1) he wills it to you, or unless (2) you are on the deed with survivorship rights or (3) a divorce decree awarded you rights in the property. After a divorce, you cannot revisit the property settlement, so you ask a questoion now that should have been asked before the divorce when it could have been addressed.
