Legal Question in Family Law in Georgia

My wife had child support papers mailed to me today requesting a child support hearing even though we have not divorced nor spoken of divorce. She took our child and simply moved 2 weeks ago. Is it leagal to do this without divorce first? also would like to know how to request DNA testing.

Yes, she can. And it is imperative that you immediately get a lawyer. You have a legal duty to pay child support even absenta court order; after 30 days of non-support you can be jailed.

You need a lawyer IMMEDIATELY. You'll need to decide if you wish to simply debate child support, or file for divorce and determine support, custody, visitation, etc. in the divorce.

If you dispute paternity, you can request a DNA test as part of the case. You will need a proper motion, and will usually have to pay for the testing.
