Re: Number of weeks out for Medical leave

There are a number of factors to consider to know whether the Family and Medical Leave Act applies. For example, covered employers are those with 50 or more employees within a 75 mile radius of where the employee seeking leave works. Also, to be a covered employee, the employee must have both worked for the company for a year and worked at least 1250 hours in the preceeding 12 months. If it is a covered employer and employee, the employee is entitled to up to 12 weeks of unpaid leave under the FMLA for birth or adoption of a child, a serious health condition of the employee or close family member, etc. In addition, if the company has over 15 employees, leave may be a reasonable accommodation for a qualified individual with a disability. Like with the FMLA, the Americans with Disabilities Act has particular requirements and guidelines. Also, employees may be entitled to leave pursuant to policies and procedures of the employer.
