Legal Question in Medical Leave in Georgia

I requested medical leave for having knee surgery in Sept. 2009. In Dec.2009 I received a letter of termination for being on FMLA in which I was never made aware of. Now they will not hire me back as I was released from Dr. with no restrictions. Do I have any rights? Should'nt the employer made me aware of this?

When you requested FMLA time, was it granted? If so, did you expend the entire period allowed under the law. If an employee does not return to work after the FMLA period has expired, the company can fire you. If your time was not expended, but they fired you in retaliation, you may have claim. More information is needed. You can contact me at [email protected].
