Legal Question in Civil Litigation in Georgia

Suing a Former Business Partner

I, along with two other people (Parnter A and Parnter B) started a business. Partner A invested $10,000 cash to get the business started. Partner B over time withdrew all of this money for personal use. Partner A wants to file a suit; however Partner A has been deployed to Iraq for at least six months. As the third partner, siding with Partner A, can I act as a plaintiff representative for Partner A?

Re: Suing a Former Business Partner

You cannot sue on behalf of A. However, you may be able to start the process of having the partnership file suit.

Consult with an attorney.

Sure, you can start the process now. You can file under the partnership name.

Re: Suing a Former Business Partner

No. You would not have standing to file suit for claims that Partner A has. And trying to file on behalf of Partner A would be practicing law without a license. However, an attorney could file for Partner A.
