Your boyfriend's situation is quite complex and would involve a detailed consultation. He has several issues concerning inadmissibility (unlawful presence possibly, criminal conviction depending on the type) and whether refugee status might be possible overlooking possible inadmissibility.
I would need to get detailed facts about where he is from and about his immigration activities. I would also have to do some research into the nuances of a case like this as it is not simple. For example, few refugee claims are made from Mexico and prevail. The arguments would have to be developed in a novel way and whether there is authority to borrow from to use for this context I do not know without investigating. If hired, I would give my opinion first before proceeding after your decision. It is unclear at this time whether doing nothing is better than doing something.
The above is informational and not legal advice upon which you can rely. It does not form an attorney client relationship. For further information, feel free to call me at 818 609 1953 or write me at [email protected].
