Auto Insurance Co. won't pay claim

An illegal Mexican laborer hit my car. The police report states in writing that he ''failed to yield and struck vehicle 2(me)'' yet his citation on the report was for ''driving without a license'' not for hitting my car.

His insurance company does not want to pay the $1024 claim because the citation was for no license rather than causing the accident. The GA insurance commissioner's office says that the at fault driver is responsible to pay me out of pocket. This person is long gone back to Mexico so that is not an option.

Can I sue the insurance company for this claim? Small claims? Do I need a lawyer? Will a lawyer sue for his fees too?

You would have to sue the driver, which sounds extremely difficult. Your best bet is to file a claim with your insurance carrier under uninsured motorist coverage.
