Legal Question in Employment Law in Georgia

Fraternization v/s discrimination

I was out of work under FMLA for knee surgery for 4 weeks. When I returned and worked 2 weeks,I turned my FMLA papers in on a Friday, which stated that I would be having another surgery in 4 weeks, and the folowing Tuesday was terminated.I was not given a seperation notice only a employee counseling notice that stated that I was being terminated for sexual harassment, fraternization, and standard of conduct. The allegations were brought forward from an exemployee who stated that they recieved a sexual text message and there is no proof of anything.I have not harrassed anyone and asked to see proof of the allegations and not even names of accusers. The fraternization allegations are due to employees and families assocating outside of work.the policy states that they encourage employees to develop friendships and social relationships with other employees and their families. The things listed that are not encouraged are sexual or intimate relations. We never received any kind of warning. They terminated me and my employee, both females, for fraternization.Suggesting that we were intimate. The HR had been supposedly conducting investigation for 11months, but only acted after I came back from FLMA. Do we have a case for slander & discrimination

Your question is beyond what could be answered here, and there is no way anyone could speculate about whether you have a case based on a paragraph. You provided scant mention of their specific allegations, and no denials but for a comment that you did not "harass" anyone. See a lawyer to discuss all relevant facts and get a qualified opinion. Keep in mind that if they did in fact fire you for e-mails, "fraternization," or such things, that most people are employees at will, and can be fired for any reason or no reason (but for race, age, gender, and the like).
