60-day notice

If my lease runs out on Oct. 31, and I didn't sign anything saying I wanted to renew--do I still have to give a 60-day notice as it states in the lease, or is my obligation to the landlord completely over on Oct. 31. I did inform them on Sept. 29 that I would be vacating on Oct. 31 and now they are demanding I pay November's rent even though I won't be there and have no access to the apartment. Is this fair?

If the lease agreement states that you must give 60 days' notice, which is very common, then you are required to do so. On the other hand, you should have access to the apartment while paying rent.

We do not have a copy of your lease. What does it say about notice, and what happens at the end of the lease if notice is not given? "Fair" is what both parties agreed to when the lease was signed.
