Legal Question in Real Estate Law in Georgia

abandoned house

The house next door to mine has been abandoned for about 3 months. It was foreclosed.

The previous residents trashed the house inside and out before moving out, so the house is infested with pests that are of course spreading to my house. I have contacted my county Public Health Department, the Code Enforcement that actually managed to get the one foot tall grass mowed and finally the bank that owns it now. When I first contacted the bank (in mid October) they said they couldn't send an inspector to the house until an eviction process was final. So I finally got in contact with the County's Magistrate Court who informed me the eviction was final in September 30th.

In other words, the bank is most likely not willing to do anything to the house, since they will not sell it anytime soon, on the other hand I find unacceptable that they, as owners, seem not to be held accountable for the health hazard that house has become.

I would appreciate any suggestion on how to proceed.

Thank you,

Re: abandoned house

Since the bank now owns the property, you can file an action to abate a nuisance. Take a look at Title 41 of the GA code. You can find it at your local law library.
