Failure to return security deposit within 30 days

The day I moved out of rental property the landlord met me there and stated house looked great, didn't have security deposit with her and asked if we could meet somewhere. She then said it would probably be easier to mail it, asking my new address. She then stated that she would send it at the beginning of the week. I waited 2 weeks to receive check, tried calling her twice asking her to please communicate with me. I sent a certified letter which she did not pickup until last day. She sent me a letter 40 days after move out stating we would not receive any of deposit due to damages to property.

If she does not return it pronto, you should consider suing her in Magistrate Court (or State Court, if you know how to do it) for a refund. In certain circumstances you may be entitled to 3 times the value of the Security Deposit as damages against the LL for the LLs wrongful withholding of the SD. GO see the FAQ on my website.
