Legal Question in Real Estate Law in Georgia

lease /purchase termination

I'am the owner of a home in Georgia, we currently have a 2 yr lease purchase agreement and the tenant have consistanly paid late and have not paid for the month of November. The lease was signed on 1/31/2000.

How can I get them out of the house or terminate the lease so I can sell the house. Thank You

In answer to your question regarding your tenant's, you have possibly waived your right to evict for late payments of rent because it sounds like you have accepted them. However, failure to pay rent is automatic grounds for a dispossessory action. Seek out a lawyer for assistance in filing this action. But non-payment of rent allows you to evict. But read your lease and then seek an attorney.

First, in GA, you need to follow the terms of your Lease/Purchase (L/P) agreement. Its terms may control by contract. Send the T a strict performance letter (demanding strict performance to all terms of the LP) and then enforce it. Once you can show a breach for nonpayment, declare the LP breached in writing and bring a dispossesory action in the County in which the house is located. Hugh Wood
