Neighbors dead tree resting on our tree

Our neighbor has a tree that is now resting against our pine tree by it's top branches and leaning towards our house. The roots of the tree are exposed and my husband has taken pictures and notified the neighbor by a certified letter that the tree could fall on our house or worse kills an animal or a child. The neighbor then noted in a letter ''that since the tree is resting on our property and it is not witihn our authority to engage in any activity that involves your property. If you are desirous of removing the tree, you have permission to hire a licensed, bonded and insure professional and give them access to our property. I ask only that you give me notice as to when the removal will occur and provide me with the contractor's name and a copy of their proof of insurance in advance.''

What now do we do? Are we liable or not?

Your neighbor is responsible for for this situation. You should consult with a local attorney to put your neighbor on notice that he/she should remove the tree.
