Legal Question in Real Estate Law in Georgia

I have a situation I gave a 1300.00 security deposit to Jai property mtg in which i decieded not to move in due to them not doing certain things to the home I never signed any paper work stating my deposit is non refundable and was told I will recieve a full refund once the office manager spoke with the owner he declined to return my full deposit what should I do to recieve my full deposit back? will it be a good idea to hire an attorney or represent myself in small claims court?

You gave someone $1300 with no paperwork at all? That is pretty unbelievable. Who would do that? And how do you think you'd possibly convince a judge you did?

Obviously something got signed - at least an application. That's the first thing JAI makes you do before they talk to you. Post what actually happened and you will get a meaningful answer. Make up a story and you will get a pretty useless answer.

BTW, when you filled in your original credit app form to talk to JAI did you bother to read the bottom which clearly says:

NOTICES:

I understand that application fee or any deposit ( or partial deposit ) paid to Jai Property Management will not be refundable to me if I decide not to move into the property.

I'd suggest in future reading what you sign would help you a great deal and that when you sue don't be surprised in JAI and the owner win attorneys fees from you for a frivolous suit.

(Every JAI credit app has the same language. They are a lessor of last resort for folks that have bad credit and get turned down by other foks).
