transfer of deed to a dead person

my sister was deeded my mothers home several years ago there was a deed made back to her mother that the mother never intended to file. the mother died and four months later the other brother filed the deed to force the home into probate. Is it legal to transfer a deed into a dead persons name?

The property became that of the mother when she accepted the deed, not when the deed was recorded. The recording simply puts "the world" on notice that the mother owns the property. I would suggest you consult with a local attorney who can review the facts and documents. He/she may uncover something that is important.
