Legal Question in Traffic Law in Georgia

CDL license suspension

I was pulled over in Paulding County. A wrecker had pulled out in front of me with a load od pallets and I moved over into the left lane and before I could get over I came up on a red light. The officer pulled me over for being in the left hand lane. I explained what happened and he said he was going to give me a warning citation. When he came back to my truck he told me my license had been suspended and arrested me for being in the left lane and driving with a suspended license. I was not aware that my license had been suspended. I have 2 tickets, the last one in May 2005. I paid both tickets. I was never notified of any suspension. I am going to lose my job because of this. What can I do?

Re: CDL license suspension

First thing is that you need to hire an attorney. You lic. may be suspended due to a mistake. You are required to be served with notice of suspension in order to be prosecuted for it. The notice will have been via certified return receipt mail to the address on your lic. Go to you local PD and have them run your driving history ... there is a small fee. Then try to straighten out what is wrong prior to court. But I would still suggest hiring an attorney since being found guilty to suspended lic with resuspend the lic for another year. Good luck.
