Legal Question in Wills and Trusts in Georgia

attempt to defeat living trust

after my father's death his 2nd wife is claiming ''years support'' from trust assets specifically left to his children. 2nd wife was not listed in trust as beneficiary. Father gave second wife substantial funds outside of trust during his 3 year marraige for future support. 2nd wife is now attempting to claim assets held in trust

In Georgia, a spouse can claim years support from an estate. That claim comes ahead of bequests by will. You should consult with your attorney to determine how that applies in your case.
