Legal Question in Wills and Trusts in Georgia

Contesting a will

My great aunt left me her house and money in her will. She has three sisters that are contesting the will. My questions are: How much of a chance do they have to win? How long can they keep this in probate? My gr. aunt did not get along well with her sisters. They never visited or called, even when she was sick. When they sent her home with hospice, they never came over or even asked if she needed anything. Me and my husband gave up our house we were renting to live with her to take care of her. I did not ask her to leave this to me, in fact, I told her I did not want her to do it because it would cause problems with her and her sisters. She told me she would tell her sisters before she did it. She did not tell them, they found out at the funeral. My gr. aunt had a life insurance policy, I gave that to one of her sisters. We have been to mediation to try and sort this out to no avail, they want it all. I don't think my lawyer is any help, he is not doing anything to help, he just waits until they do make a move, then does whatever their lawyer says. Meanwhile, this is still tied up in probate (it's been about two years)I'm tired of waiting, any suggestions?

Re: Contesting a will

If you are named in the will, and the will is admitted to probate, there is a strong likelihood of your getting whatever is bequethed in the will. But your question does not otherwise give me enough information for answering your questions. Most importantly, you did not say on what basis they were contesting the will.

Re: Contesting a will

You should get whatever the will says you are to get. You might want to consider getting a new lawyer.
