Craftsman Dies Before Job Completion w/o Will

The contract for cabinet refacing was paid 1/2 up front.($3,500) The cabinet man had installed only the refrigerator surround. He had cut out most of the cabinet doors but had not assembled them. He died suddenly w/o a will. His stepson was appointed to administer the estate. The stepson contracted with another cabinet man to finish my kitchen using the materials already cut plus adding other materials. The new cabinet man, after looking at my job, says he cannot do it for the remaining money because the materials did not amount to 1/2 the costs. Also, he is not a craftsman, but an installer. I have asked the stepson to refund the money I had paid so that I can get a quality job. He says he can only sell assets and cannot distribute any money. This has been going on since July, 2003. What are my options?

Go to the Probate Court in the County where the estate is being probated. File a claim for the amount owed. There may/may not be a hearing. If it is not paid, you may have a cause of action against the administrator as he is the fiduciary of the estate.
