Legal Question in Wills and Trusts in Georgia

Legal Heir

My biological father recently died (2007). I have since found out that my father and mother were not married when I was born. He was still legally married to someone else with whom he had four children. Also, I was not raised by my biological father. Am I considered an heir that is legally entitled to anything from his estate? My biological father resided in Georgia and there was no will.

Re: Legal Heir

If he left no spouse, you and the other four children each get 1/5 of the estate and you should hire a lawyer immediately. If he left a spouse, the spouse also will have part of the estate.

Re: Legal Heir

All the other stuff does not change the fact that you are his son and, therefore, an heir. As to how much you can receive, that's where the other relationships come into play. Consult with a local attorney.
