Legal Question in Wills and Trusts in Georgia

Mother-in-law dies without a will

My wife and I live in Florida. My mother-in-law, who lived in Georgia and was the last remaining parent of my wife and her sister, died without a will almost a year ago. My sister-in-law who also lives in Georgia has stated she is no hurry to settle the estate. Because of the distance involved, my wife has depended on her sister to complete the process so they both can move on with their lives. I am concerned that there are issues involving the state of Georgia that she has ignored which could eventually affect both my wife and sister-in-law in terms of law and/or final property settlement. How can we get her to move on this matter and what does Georgia law say about the settlement of personal property of a person who dies intestate?

Re: Mother-in-law dies without a will

I would be concerned that the sister does not want to expedite resolution of the estate. I would suggest consulting with an attorney in the county of your mother-in-laws residence about having an administator appointed. Many counties have court-appointed attorneys who fill this position when no one else has come forward.
