Probating my grandfathers will

I am in the process of probating my grandfathers will. I want to purchase my aunts half of the estate. I have had the home appraised for $109,500 however several realtors have said that on todays market the house would only sale for between $90,000 and $95,000 can I legally ''buy'' the house for less than the appraised value??? I have considered splitting the difference.

You cannot rely on the word of a real estate agent. They are in the business of selling property. You should consult with a local attorney about what the court will approve. You will probably need to get court approval (Leave to Sell) anyway.

Your attorney is the one you should be discussing this with. If you get it wrong, it is very likely that you will get sued. Talk to the attorney you hired to handle the estate.

Even buying it for the appraised value is risky if you act without your aunt's consent, or a court order approving the sale.
